Terms and Conditions
Proposed terms for accounts, creative services, bookings and payments.
Pyvira and these terms
Pyvira is a marketplace for discovering creators, arranging creative services and managing bookings, delivery and payments. These draft terms describe the proposed rules for clients and creators. The supplied operator name is Pyvira, in Germany; its full business address and legal form are awaiting confirmation.
The final terms must identify the parties to each service contract and Pyvira's exact contractual role before they are adopted. This draft is not a substitute for that information.
Accounts and eligibility
The proposed service is intended for adults aged 18 or over who can enter binding contracts. If acting for a business, you must be authorized to do so. Provide accurate account details, protect your sign-in credentials and report suspected misuse.
Creators are responsible for accurately describing their services, qualifications and availability, and for obtaining permissions, registrations and insurance required for their work. A platform badge is not a guarantee of suitability for every booking.
Agreeing to a booking
Before accepting work, agree on the service, date, location, price, currency, deliverables, deadlines, revisions and usage rights. Record changes in the booking conversation. Additional services and expenses should be agreed before they are incurred.
A booking marked confirmed does not by itself establish that payment has been received. Check the separate payment status. Availability can change; a public listing is not a guarantee that a requested date has been reserved.
Client payments and creator earnings
Under the proposed platform-payment flow, clients pay through Pyvira's checkout. Review the booking amount, currency and any disclosed fees before paying. Your bank or payment provider may apply its own conversion or transaction charges.
Pyvira deducts a 15% platform fee from the gross booking amount before calculating the creator's payout. For example, on a €100 booking, the Pyvira fee is €15 and the creator's estimated payout is €85. The applicable amount is shown before acceptance and in the booking payment breakdown.
Pyvira uses Stripe to process payments and creator transfers. Creators provide payout details and complete required verification through the payment provider; they are not asked to supply API keys. Earnings may be released after delivery approval and platform review, subject to disputes, refunds and verification.
A payout marked released means a transfer to the creator's payout account, not guaranteed arrival in a bank account. Provider processing times and payout schedules apply. Do not interpret a payment-status label as a regulated escrow service.
Delivery, revisions and usage rights
Creators should deliver the agreed files and explain material changes. Clients should review the work and either approve it or describe the changes needed against the agreed brief. Revision requests do not automatically expand the purchased service.
Specify licensing or ownership, commercial use, territory, duration, attribution and whether raw files are included before booking. Payment alone does not define an unlimited transfer of intellectual-property rights. Each party must have permission to provide materials it supplies.
Cancellations, refunds and consumer rights
Notify the other party promptly if a booking must be changed or cancelled. Cancellation does not automatically mean that a payment has been refunded. Refund eligibility must be assessed against the disclosed booking terms, work performed and applicable law.
No universal cancellation charge or non-refundable deposit is established by this draft. Mandatory consumer rights, including applicable withdrawal and remedies for non-performance, are not waived by these terms. Any request to start services during a statutory withdrawal period requires a compliant process.
Acceptable use and disputes
Follow the Community Guidelines. Do not misuse accounts, payment systems, reports or reviews, infringe others' rights or upload harmful files. Keep communications professional and relevant to the work.
Use the booking dispute controls for problems with delivery or payment and provide accurate supporting information. Platform review does not remove statutory rights, access to courts or rights available through a payment provider.
Account restrictions and changes
Access may need to be restricted to address fraud, serious misconduct, security risks or legal obligations. Outstanding bookings, refunds and legitimate payment obligations still need to be addressed when access ends.
Material changes to adopted terms should be communicated before they take effect where required. They should not silently rewrite an existing booking. Liability provisions, governing law, dispute-resolution notices and the acceptance process remain subject to legal review; no blanket exclusion of liability is established here.
